I hereby make application for such share as may be due me of the fund appropriated by the Act of Congress approved June 30, 1906, in accordance with the decrees of the Court of Claims of May 18, 1905, and May 28, 1906, in favor of the Eastern Cherokees. I drew “strip” funds in 1894, my allotment and all other per-capita payments made during my life.

I am unable to answer the above question.

REMARKS (Under this head the applicant may give any additional information that he believes will assist in proving his claims.)

Please observe that the name is spelled two ways. I am enrolled on all the late rolls as (Tyner) and the old way of spelling it seemed to be (Tiner). Owing to the fact that my grand mother was a Seabolt and not being able to learn any thing about that family wish to reserve the right to file all other claims that may here after arise.

Personally appeared before me John C. Duncan and Joanna C. Duncan who. being duly sworn, on oath depsoe and both say they are well acquainted with Weaver Tyner , who makes the foregoing application and statement and have know him for 10 years and 10 years respectively, and know him to be the identical person he represents himself to be, and that the statements made by him are true, to the best of their knowledge and belief and they have no interest in his claim.
